Terms of Service
Last updated: November 6, 2026
1. About These Terms
These Terms of Service apply to your use of mcgconsults.com and to the free assessment offered through it. They are between you and MCG Consults ("we," "us," or "our"). By using the website or requesting an assessment, you agree to them.
Paid work is covered by a signed Master Service Agreement and a Statement of Work for each project. If anything in those documents differs from these terms, the signed agreement wins.
2. Our Services
MCG Consults provides IT consulting for small businesses, including:
- Process automation
- Connecting software and moving data between systems
- Reliable IT basics, such as accounts, sign-in, backups and server care
- Moving old or paper-based processes into modern tools
3. The Free Assessment
- The assessment is free and creates no obligation for either of us.
- It is our honest opinion based on the information you send. It is not a binding quote or a guarantee of results.
- Please don't send passwords, account access or sensitive personal information through the website form. If we need access later, we'll arrange it securely.
4. Proposals and Agreements
- Before any paid work starts, we agree in writing on what will be built, how long it will take and what it will cost.
- Fixed-price projects begin once the agreement is signed and the deposit is paid.
- If you want something outside the agreed plan, we'll quote it before doing it.
5. Payment
- Fixed-price projects are billed half up front and half at completion, unless your Statement of Work says otherwise.
- Invoices are due within 15 days of the invoice date.
- Unpaid balances accrue interest of 1.5% per month starting the day after the due date.
- We may pause work on accounts that are more than 15 days past due until they are paid.
Our full payment policies are in the Invoice Terms provided with every agreement.
6. Your Responsibilities
As a client, you agree to:
- Provide accurate information and the access a project needs
- Respond to questions and review work in a reasonable time
- Make sure you have the right to use the software, accounts and data you ask us to work with
- Pay invoices as agreed
7. Ownership of Work
Unless your agreement says otherwise:
- You keep ownership of your existing data, systems and materials.
- Work we build specifically for you becomes yours once it has been paid for in full.
- We keep ownership of our pre-existing tools, methods and reusable components. Where they are part of your deliverables, you receive a permanent license to keep using them.
8. Confidentiality
We keep your business information confidential and use it only to do the work you've asked for. We will not disclose it to anyone else without your written consent, except as required by law. We're happy to sign a non-disclosure agreement before looking at your systems. How we handle personal information is described in our Privacy Policy.
9. Warranties and Disclaimers
We will perform our services professionally, and deliverables will substantially match what was agreed in the Statement of Work. Beyond that, our services are provided "as is," and we can't guarantee specific business outcomes, such as a particular number of hours saved.
The content of this website, including the hours calculator and the example projects, is general information to help you think about your business. It is not professional advice for your specific situation. The examples are typical of the work we take on, not results from specific clients.
10. Limitation of Liability
To the extent the law allows, our total liability for any claim related to our services is limited to the fees you paid us in the 12 months before the claim. Neither party is liable for indirect, incidental or consequential damages, including lost profits or lost data.
11. Ending an Agreement
Either party may end an ongoing agreement with 30 days' written notice, or immediately for an uncured material breach as described in the Master Service Agreement. You pay for the work completed up to that date, and we deliver all completed work.
12. Using This Website
You may use this website to learn about our services and contact us. Please don't misuse it, for example by sending spam through the form, trying to break or overload the site, or copying its content for commercial use. The text, design and logo on this site belong to MCG Consults. Links to other websites are provided for convenience, and we are not responsible for their content.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Kansas. If a disagreement comes up, we'll first try to resolve it through good-faith discussion. If that doesn't work, any legal proceedings will take place in Leavenworth County, Kansas, unless your signed agreement says otherwise.
14. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with a new "Last updated" date. Changes don't alter an agreement you have already signed.
